Cancellation and Return Policy
Effective Date: 1 June 2025
These Terms and Conditions (“Terms”) govern your use of the online platform provided via www.championchip.co.za (the “Platform”).
ChampionChip Africa is always committed to the highest ethical standards of business and protection of customers rights. By accessing or using the Platform, completing any transaction, or submitting any information, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Parties and Intermediary Role
ChampionChip Africa (Pty) Limited (“ChampionChip Africa”, “we”, “us”, or “our”) operates and supplies the technical online solution (including registration, payment processing integration, and team portals) as an intermediary service provider for organisations hosting a variety of events, (the “Event Organizers”).
ChampionChip Africa are not the primary event organizer, beneficiary, or direct recipient of funds for charitable or project purposes.
ChampionChip Africa facilitate transactions securely and hold funds temporarily until they are transferred to the relevant Event Organizer(s) in accordance with agreed schedules. Once funds are transferred to the Event Organizer, any queries regarding refunds, participation, or fulfilment must be directed to the specific Event Organizer and we operate under the Event Terms accepted by the participant at the time of transacting and manage any refunds under instruction from the respective event organiser where appropriate.
Services
The Platform enables:
– Event registration.
– Sponsorship for events.
– Donations to events and/or event participants or charities.
– Access to resources, team portals, and event information.
– Integration with a Secure Online payment gateway for secure card and other payments.
3. Payments and Payment Gateway
All payments are processed securely via a Secure Online payment gateway. You authorize us to process your payment details for the selected transaction vie the configured payment gateway.
Transaction fees (if any) will be clearly displayed before confirmation.
We use reasonable efforts to protect your payment information but do not store full card details on our servers and all card details are processed directly by the appointed secure payment gateway.
Funds are protected while held by us or our payment partners until transferred to the Event Organizer.
Important:ChampionChip Africa acts solely as an intermediary. We do not guarantee event outcomes, , timelines (beyond our procurement role where applicable), or specific event results. These are the responsibility of the Event Organizers.
4. Refund Policy
Refunds are governed by the following policy, in line with the South African Consumer Protection Act (CPA) and Electronic Communications and Transactions Act (ECTA) where applicable:
Cancellations within cooling-off period: For transactions concluded via direct marketing or online, you may have a cooling-off right (typically 5 to 7 days depending on the nature of the transaction). Contact the relevant Event Organizer promptly.
General refunds: Refunds are not automatic. Sponsorships and donations are generally non-refundable once processed and transferred, as they support charitable/community projects. Exceptions may be made at the sole discretion of the Event Organizer (e.g., event cancellation, technical errors, or non-delivery of tangible items like dominoes).
Process: Any refund request must be submitted in writing to the relevant Event Organizer (details provided on your team portal or confirmation). We will facilitate the refund only if instructed by the Event Organizer and before funds are transferred.
After funds are transferred to the Event Organizer, you must pursue recourse directly with them.
Refunds (where approved) will be issued to the original payment method within 15 business days where required by law, minus any applicable transaction or administration fees.
We strongly encourage reviewing the specific rules and guidelines for the event when transacting before sponsoring or donating.
5. Protection of Personal Information (POPIA Compliance)
ChampionChip Africa is committed to complying with the Protection of Personal Information Act, 4 of 2013 (“POPIA”). We are a responsible party (or operator, as applicable) for personal information collected on the Platform.
ChampionChip collect personal information such as name, contact details, and event-related preferences solely for:
– Processing registrations, sponsorships, and donations.
– Communicating about the event and providing support.
– Fulfilling legal and contractual obligations.
– Improving the Platform (anonymized where possible).
Key POPIA Principles we adhere to (the eight conditions for lawful processing):
– Accountability: We ensure compliance.
– Processing limitation: Data is collected lawfully, minimally, and with consent where required.
– Purpose specification: Data is used only for the stated purposes.
– Further processing limitation, information quality, openness, security safeguards, and data subject rights: We maintain accuracy, transparency, security (reasonable technical and organizational measures), and honor your rights (access, correction, deletion, objection, etc.).
You consent to us sharing necessary information with Event Organizers, and service providers (under operator agreements) for the above purposes. We do not sell personal information.
Your rights: You may access, correct, or request deletion of your data by contacting us (details below). We retain data only as long as necessary or as required by law.
6. User Responsibilities and Conduct
– You must provide accurate, complete information.
– You warrant that any sponsorships/donations are made lawfully and with authority.
– You must comply with the Events Rules and Guidelines.
– You agree not to use the Platform for unlawful purposes or to infringe rights.
7. Intellectual Property
All content on the Platform (logos, designs, resources) is protected. Limited personal use is permitted; commercial reproduction requires prior written consent.
8. Disclaimers and Limitation of Liability
The Platform is provided “as is.” We disclaim warranties to the extent permitted by law.
We are not liable for losses arising from Event Organizer actions, event outcomes, third-party content, or force majeure.
Our total liability is limited to the value of the specific transaction in question.
This does not limit liability for gross negligence, fraud, or as prohibited by law (e.g., CPA).
